After viewing an attorney’s video celebrating his successful defense of a doctor in a medical malpractice lawsuit, the judge vacated the jury’s verdict. Attorney Robert McKenna III’s video bragging about his strategy for winning the not guilty verdict involving “a guy that was probably negligently killed” by making “it look like other people did it” prompted Orange County Superior Court Judge James Crandall to order a new trial in the malpractice lawsuit filed by the family of a man who blamed his death on a perforated colon caused by a misplaced feeding tube. The judge, who also cited other circumstances that warranted a new trial, commented, “Well, bragging isn’t a great irregularity. He’s a lawyer. But here’s the problem: Bragging that justice wasn’t done, that’s what bothers the court.”
