The family of a pedestrian who was struck and killed by a vehicle driven by a former Coastal Carolina University football player who was employed as a graduate assistant for the team at the time of the drunk driving crash has sued a now-defunct tavern, alleging it overserved alcohol to the driver on $1 drink night, leading to the fatal crash. According to the lawsuit, in January 2020, 55-year old Timothy Shulkcum, an eight-year veteran of the US National Guard, was standing in the median of a highway near Conway helping his sister refuel her vehicle when he was killed by a truck driven by CCU graduate assistant Riley Patton. The suit alleges Patton consumed 10 to 15 vodka drinks and several shots of liquor at American Tavern, which shut its doors in April 2020. Police measured Patton’s blood alcohol level just after the crash at 0.163, double the legal limit. Attorneys for Shulkcum’s estate said they filed the lawsuit only after unsuccessful settlement talks with the tavern’s insurer, which asserted that it would not cover incidents involving drinks that cost less than $3.
